terms of use

end user license agreement (EULA) · effective: July 1, 2026

this end user license agreement ("agreement") is a legal agreement between you and pongsixtyfour studios, operated by Pongsixtyfour Studios LLC of North Carolina, USA ("we", "us", the "application provider"), governing your use of the figured series of apps — currently Crossums and Sequences — and any updates (the "apps"). by downloading or using an app, you agree to these terms. if you do not agree, do not use the apps.

1. acknowledgement

you and we acknowledge that this agreement is concluded between you and us only, and not with Apple Inc. or Google LLC. we, not Apple or Google, are solely responsible for the apps and their content. this agreement does not provide for usage rules that conflict with the Apple Media Services Terms and Conditions or Google Play's Terms of Service, which you acknowledge you have had the opportunity to review.

2. scope of license

we grant you a limited, non-transferable, non-exclusive license to use the apps on any device that you own or control, as permitted by the usage rules of the App Store or Google Play, except that the apps may be accessed and used by other accounts associated with you via Family Sharing or similar account-sharing features. the license does not allow you to use the apps on a device you do not own or control, and you may not distribute or make the apps available over a network where they could be used by multiple devices at once.

3. purchases and payments

the apps are sold to you by Apple or Google through their respective stores. each app includes its first puzzle volume with the purchase, and offers optional in-app purchases that unlock additional puzzle volumes, individually or as a bundle. all in-app purchases are one-time, non-consumable purchases — there are no subscriptions, no consumable items, and no recurring charges. purchased volumes stay unlocked and can be restored on any device signed in to the same Apple or Google account using the restore purchases option in the app. all payments are processed by Apple or Google under their own terms. prices are shown before you buy and may change. refunds, where available, are handled by Apple at reportaproblem.apple.com or by Google through the Google Play refund process.

4. acceptable use

you agree not to reverse engineer, decompile, or disassemble the apps except as permitted by law; not to rent, lease, lend, sell, or sublicense the apps; and not to use the apps for any unlawful purpose.

5. maintenance and support

we are solely responsible for providing any maintenance and support services for the apps, as we specify, or as required by applicable law. you acknowledge that neither Apple nor Google has any obligation to furnish maintenance and support services with respect to the apps. reach us at support@pongsixtyfourstudios.com.

6. warranty

we are solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. in the event of any failure of an app to conform to any applicable warranty, you may notify the app store provider, and they will refund the purchase price for that app to you (if applicable), to the maximum extent permitted by their own terms. any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be our sole responsibility.

7. product claims

we, not Apple or Google, are responsible for addressing any claims by you or any third party relating to the apps or your possession and/or use of the apps, including but not limited to: (a) product liability claims; (b) any claim that an app fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar legislation.

8. intellectual property

the apps, including all content, marks (including the {64} mark), and code, are owned by us or our licensors and are protected by intellectual property laws. in the event of any third-party claim that the apps or your possession and use of the apps infringe that third party's intellectual property rights, we, not the app store providers, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.

9. legal compliance

you represent and warrant that (a) you are not located in a country subject to a U.S. government embargo or designated as a "terrorist supporting" country; and (b) you are not listed on any U.S. government list of prohibited or restricted parties.

10. disclaimer & limitation of liability

to the maximum extent permitted by law, the apps are provided "as is" without warranties of any kind, and our total liability for any claim arising out of the apps will not exceed the amount you paid for the relevant app. nothing in this agreement limits liability that cannot be limited under applicable law.

11. third-party terms & beneficiary

you must comply with applicable third-party terms of agreement when using the apps. you and we acknowledge and agree that Apple and Google, and their respective subsidiaries, are third-party beneficiaries of this agreement, and that, upon your acceptance of this agreement, each will have the right to enforce this agreement against you as a third-party beneficiary thereof.

12. termination

this license is effective until terminated. your rights under this license will terminate automatically if you fail to comply with any of its terms. upon termination you must stop using the apps and delete all copies.

13. governing law

this agreement is governed by the laws of North Carolina, USA, without regard to its conflict-of-laws rules, except where preempted or superseded by applicable consumer or mandatory law.
